41-1552.03. Requirements for disbursement of monies

The commission shall not disburse any monies to a small business until all of the following requirements have been met:

1. The small business has completed its SBIR or STTR phase I research and development.

2. Its final phase I report with respect to the research and development has been submitted to the appropriate federal agency.

3. The small business has notified the commission of its intent to submit a phase II research and development proposal to the federal agency.

4. It has submitted to the commission either copies or summaries of its final phase I report, as specified by the commission.

5. The small business demonstrates that it will attempt to manufacture any product resulting from the research and development from these grants in Arizona.

6. A written agreement between the small business and the commission has been executed requiring the small business to repay to the state all funds received under this article, subject to the following requirements and conditions:

(a) Repayment may be made in a lump sum, in installments or by other methods as determined by the commission.

(b) Interest shall not accrue on the funds.

(c) Repayment shall commence upon the earlier of five years after the grant has been awarded or the successful completion by the small business of its SBIR or STTR phase III commercialization efforts to sell or license the developed technology. The commission shall establish guidelines to define the success criteria for purposes of repayment.

(d) The requirement for repayment shall be contingent upon the small business successfully completing its SBIR or STTR phase II development and phase III commercialization efforts.

(e) Other provisions deemed necessary by the commission.
