200.  Notwithstanding any other provisions of this code, anyrevenues, collections, or receipts accruing to any board in thedepartment may, in the manner determined by the director and with theconsent of the board concerned, be received and deposited by thedepartment, and in such case shall be accounted for to the board andremitted by the department to the State Treasury in accordance withlaw for credit to the fund of such board. Notwithstanding Section 158of this code, all refunds shall be made by the department with theconsent of the board.200.1.  (a) Any accruals that occur on or after September 11, 1993,to any funds or accounts within the Professions and Vocations Fundthat realize increased revenues to that fund or account as a resultof legislation enacted on or after September 11, 1993, and that havenot been transferred pursuant to Sections 13.50, 13.60, and 13.70 ofthe Budget Act of 1993 on the effective date of the act that enactedthis section, shall be exempt from the transfers contained inSections 13.50, 13.60, and 13.70 of the Budget Act of 1993. Thesefunds shall include, but not be limited to, all of the following: (1) Athletic Commission Fund. (2) Bureau of Home Furnishings and Thermal Insulation Fund. (3) Contractors' License Fund. (4) Private Investigator Fund. (5) Respiratory Care Fund. (6) Vocational Nursing and Psychiatric Technicians Fund. (b) Subdivision (a) shall not apply to the Contingent Fund of theMedical Board of California.201.  A charge for the estimated administrative expenses of thedepartment, not to exceed the available balance in any appropriationfor any one fiscal year, may be levied in advance on a pro rata sharebasis against any of the funds of any of the boards, bureaus,commissions, divisions, and agencies, at the discretion of thedirector and with the approval of the Department of Finance.202.  (a) Upon proper presentation of claims by the department tothe State Controller, the State Controller shall draw his or herwarrant against any of the funds of any one of the boards to coverits share of the estimated administrative expenses of the department.The fund of one board shall not be used to pay the expenses of anyother board. (b) Nothing in this section or in Section 401 shall prohibit thetransfer of funds for a release time bank of any board, commission,or bureau of the department pursuant to a memorandum of understandingon the same terms and conditions applicable to other state agencies.202.5.  Prior to payment to the Department of Justice of any chargesfor legal services rendered to any board within the department, theDepartment of Justice shall submit to the board an itemized statementof the services and charges. The itemized statement shall includedetailed information regarding the services performed and the amountof time billed for each of those services.203.  The amount of the warrant shall be remitted to the StateTreasurer by the department for credit to the Consumer Affairs Fund.The department shall pay all of its necessary administrative expensesout of the Consumer Affairs Fund.204.  A sum, not to exceed 1 percent of the total amountappropriated for all of the boards herein mentioned may be withdrawnfrom the Consumer Affairs Fund without at the time furnishingvouchers and itemized statements. This sum shall be used as arevolving fund where cash advances are necessary, and at the close ofeach biennium, or at any other time, upon demand of the Departmentof Finance, shall be accounted for and substantiated by vouchers anditemized statements submitted to and audited by the State Controller.205.  (a) There is in the State Treasury the Professions andVocations Fund. The fund shall consist of the following specialfunds: (1) Accountancy Fund. (2) California Architects Board Fund. (3) Athletic Commission Fund. (4) Barbering and Cosmetology Contingent Fund. (5) Cemetery Fund. (6) Contractors' License Fund. (7) State Dentistry Fund. (8) State Funeral Directors and Embalmers Fund. (9) Guide Dogs for the Blind Fund. (10) Home Furnishings and Thermal Insulation Fund. (11) California Architects Board-Landscape Architects Fund. (12) Contingent Fund of the Medical Board of California. (13) Optometry Fund. (14) Pharmacy Board Contingent Fund. (15) Physical Therapy Fund. (16) Private Investigator Fund. (17) Professional Engineers' and Land Surveyors' Fund. (18) Consumer Affairs Fund. (19) Behavioral Sciences Fund. (20) Licensed Midwifery Fund. (21) Court Reporters' Fund. (22) Veterinary Medical Board Contingent Fund. (23) Vocational Nurses Account of the Vocational Nursing andPsychiatric Technicians Fund. (24) Electronic and Appliance Repair Fund. (25) Geology and Geophysics Fund. (26) Dispensing Opticians Fund. (27) Acupuncture Fund. (28) Physician Assistant Fund. (29) Board of Podiatric Medicine Fund. (30) Psychology Fund. (31) Respiratory Care Fund. (32) Speech-Language Pathology and Audiology Fund. (33) Board of Registered Nursing Fund. (34) Psychiatric Technician Examiners Account of the VocationalNursing and Psychiatric Technicians Fund. (35) Animal Health Technician Examining Committee Fund. (36) State Dental Hygiene Fund. (37) State Dental Assistant Fund. (38) Hearing Aid Dispensers Account of the Speech-LanguagePathology and Audiology Fund. (b) For accounting and recordkeeping purposes, the Professions andVocations Fund shall be deemed to be a single special fund, and eachof the several special funds therein shall constitute and be deemedto be a separate account in the Professions and Vocations Fund. Eachaccount or fund shall be available for expenditure only for thepurposes as are now or may hereafter be provided by law.206.  Notwithstanding any other provision of law, any persontendering a check for payment of a fee, fine, or penalty that wassubsequently dishonored, shall not be granted a license, or otherauthority that they were seeking, until the applicant pays the amountoutstanding from the dishonored payment together with the applicablefee, including any delinquency fee. The board may require the personwhose check was returned unpaid to make payment of all fees bycashier's check or money order.207.  (a) Notwithstanding any other provision of law, the money inany fund described in Section 205 that is attributable toadministrative fines, civil penalties, and criminal penalties imposedby a regulating entity, or cost recovery by a regulating entity fromenforcement actions and case settlements, shall not be continuouslyappropriated. The money in each fund that is not continuouslyappropriated shall be available for expenditure as provided in thiscode only upon appropriation by the Legislature. (b) Notwithstanding any other provision of law, the annual BudgetAct may appropriate, in a single budget item for each individual funddescribed in paragraphs (1) to (40), inclusive, of subdivision (a)of Section 205, the entire amount available for expenditure in thebudget year for that fund. That appropriation may include funds thatare continuously appropriated and funds that are not continuouslyappropriated.210.  (a) (1) The department may enter into a contract with a vendorfor the BreEZe system, the integrated, enterprisewide enforcementcase management and licensing system described in the department'sstrategic plan, no sooner than 30 days after notification in writingto the chairpersons of the Appropriations Committees of each house ofthe Legislature and the Chairperson of the Joint Legislative BudgetCommittee. (2) The amount of BreEZe system vendor contract funds, authorizedpursuant to this section, shall be consistent with the project costsapproved by the office of the State Chief Information Officer basedon its review and approval of the most recent BreEZe Special ProjectReport to be submitted by the department prior to contract award atthe conclusion of procurement activities. (3) Paragraph (2) shall apply to all Budget Act items for thedepartment that have an appropriation for the BreEZe system. (b) (1) If the department enters into a contract with a vendor forthe BreEZe system pursuant to subdivision (a), the department shall,by December 31, 2014, submit to the Legislature, the SenateCommittee on Business, Professions and Economic Development, theAssembly Committee on Business, Professions and Consumer Protection,and the budget committees of each house, a report analyzing theworkload of licensing personnel employed by boards within thedepartment participating in the BreEZe system. (2) A report to the Legislature pursuant to this subdivision shallbe submitted in compliance with Section 9795 of the Government Code. (3) This subdivision shall become inoperative on December 1, 2018,pursuant to Section 10231.5 of the Government Code.
