17230. Notwithstanding the provisions of Article 4 (commencing withSection 17455) of Chapter 4 of this part and in addition to therequirements placed upon school districts pursuant to Section 54222of the Government Code, the governing board of any school districtmay sell, for less than fair market value, any schoolsite that isdeemed to be surplus property of the district, to any park district,city, or county in which the school district is wholly or partiallysituated for use or partial use as park or recreational purposes oropen-space purposes if the governing board adopts a resolutionspecifying that it will sell or transfer the property for less thanfair market value to such an entity for that purpose. The offer tosell shall be made in writing, but the terms by which the propertymay be sold or transferred need not be specifically provided.17231. The sale or transfer may be made for cash and other valuableconsideration, or for other valuable consideration, as deemedappropriate by the governing board of the school district. The saleor transfer may be made without first taking a vote of the electorsof the district.17232. A school district's offer to sell or transfer the land shallbe made to all park districts, cities, and counties in which theschool district is wholly or partially situated pursuant to thisarticle and shall remain open for not less than 60 days. The sale ortransfer shall be made to whichever public entity first accepts theoffer, or whichever public entity can negotiate satisfactorily forthe purchase or transfer of the surplus land.17233. Notwithstanding Article 4 (commencing with Section 17455) ofChapter 4 of this part, Article 8 (commencing with Section 54220) ofChapter 5 of Part 1 of Division 2 of Title 5 of the Government Code,or any other provision of law, any unimproved real property that wasacquired by a school district pursuant to Section 35270.5, whichproperty the governing board of the school district has deemed to besurplus property of the district, may not be sold to any person orentity within 20 years of its acquisition by the district unless thedistrict has first made a bona fide offer to sell the property to theperson or entity that owned the property at the time of itsacquisition by the district or, if applicable, offered to that personor entity a right of first refusal of any bona fide offer acceptableto the district made by another to purchase the property.17234. The failure to comply with any provision of this articleshall not invalidate any sale or transfer of real property to apurchaser or encumbrancer for value.
