17920. Any school district or county office of education mayestablish and administer a schoolbus emissions reduction fund toreceive revenue from public and private sources for the purpose ofpurchasing low- or zero-emission schoolbuses to replace, or increasethe number of, schoolbuses in the existing school district or countyfleet or retrofitting existing schoolbuses to achieve reductions inemissions.17921. A school district or county office of education thatestablishes a schoolbus emissions reduction fund may receive revenuesfrom air pollution control district and air quality managementdistrict grants, revenues from a city that are granted pursuant toparagraph (1) of subdivision (b) of Section 44243 of the Health andSafety Code, or from any other source. The school district or countyoffice of education shall contribute a majority of the moneydeposited in its schoolbus emissions reduction fund.17922. State funds may, upon appropriation by the Legislature, bedistributed to the Superintendent of Public Instruction fordistribution to districts and county offices of education for thepurchase of low- or zero-emission schoolbuses that replace, orincrease the number of, schoolbuses in the existing schoolbus fleetor for retrofitting existing schoolbuses to achieve reductions inemissions. State funds that are provided pursuant to this part shallnot exceed the amount of funds provided from other sources.17923. A school district or county office of education may enterinto contracts, including multiple year contracts, with privatesector individuals, businesses, and other entities for the purpose ofreceiving revenues to supplement its schoolbus emissions reductionfund in exchange for the issuance to the private sector contributorof emission reduction credits resulting from the purchase by theschool district or county office of education of low- orzero-emission schoolbuses or the retrofit of existing schoolbuses. Ifthere are multiple private sector contributors, each of thosecontributors shall receive a share of the credits allocated inproportion to their contribution, as specified by the school districtor county office of education at the time that the parties enterinto the agreement.17924. The Chairperson of the State Air Resources Board and theSuperintendent of Public Instruction shall jointly develop guidelinesfor school district or county office of education use that describeall of the following: (a) The manner in which school districts or county offices ofeducation may obtain funding from private and public entities fordeposit into a school district or county office of educationschoolbus emissions reduction fund. (b) The methods for determining the quantity and allocation ofemission reduction credits generated from a new bus that replaces anexisting bus or from a new or retrofitted bus that represents anexpansion of fleet capacity. (c) The methods by which school districts or county offices ofeducation located in the South Coast Air Quality Management Districtmay obtain funds from cities pursuant to paragraph (1) of subdivision(b) of Section 44243 of the Health and Safety Code.17925. Prior to distributing any state funds pursuant to this part,the Superintendent of Public Instruction shall consult with theState Energy Resources Conservation and Development Commission toavoid duplication or overlap with appropriations from the KatzSchoolbus Fund, created pursuant to Section 17911.17926. Any schoolbus replaced pursuant to this part that meets thefederal safety standards established in 1977 shall be offered forsale to school districts to replace schoolbuses that do not meet thefederal safety standards, at a purchase price not to exceed theamount of the school district or county office of education'scontribution specified in Section 17921, plus appropriateadministrative costs. This section shall not apply if the schooldistrict or county office of education certifies a continued need forthe schoolbus being replaced.
