32228.  (a) It is the intent of the Legislature that public schoolsserving pupils in any of grades 8 to 12, inclusive, have access tosupplemental resources to establish programs and strategies thatpromote school safety and emphasize violence prevention amongchildren and youth in the public schools. (b) It is also the intent of the Legislature that public schoolshave access to supplemental resources to combat bias on the basis ofrace, color, religion, ancestry, national origin, disability, gender,or sexual orientation, as defined in subdivision (q) of Section12926 of the Government Code, and to prevent and respond to acts ofhate violence and bias related incidents. Sexual orientation shallnot include pedophilia. (c) It is further the intent of the Legislature that schoolsitesreceiving funds pursuant to this article accomplish all of thefollowing goals: (1) Teach pupils techniques for resolving conflicts withoutviolence. (2) Train school staff and administrators to support and promoteconflict resolution and mediation techniques for resolving conflictsbetween and among pupils. (3) Reduce incidents of violence at the schoolsite with anemphasis on prevention and early detection. (4) Provide age-appropriate instruction in domestic violenceprevention, dating violence prevention, and interpersonal violenceprevention.32228.1.  (a) This act shall be known as the School Safety andViolence Prevention Act. This statewide program shall be administeredby the Superintendent of Public Instruction, who shall provide fundsto school districts serving pupils in any of grades 8 to 12,inclusive, for the purpose of promoting school safety and reducingschoolsite violence. As a condition of receiving funds pursuant tothis article, an eligible school district shall certify, on forms andin a manner required by the Superintendent of Public Instruction,that the funds will be used as described. (b) From funds appropriated in the annual Budget Act or any othermeasure, funds shall be allocated to school districts on the basis ofprior year enrollment, as reported by the California BasicEducational Data System, of pupils in any of grades 8 to 12,inclusive, for any one or more of the following purposes: (1) Providing schools with personnel, including, but not limitedto, licensed or certificated school counselors, school socialworkers, school nurses, and school psychologists, who are trained inconflict resolution. Any law enforcement personnel hired pursuant tothis article shall be trained and sworn peace officers. (2) Providing effective and accessible on-campus communicationdevices and other school safety infrastructure needs. (3) Establishing an in-service training program for school staffto learn to identify at-risk pupils, to communicate effectively withthose pupils, and to refer those pupils to appropriate counseling. (4) Providing and implementing instructional curricula andmaterials designed to equip pupils with skills and understandingnecessary to prevent school violence by recognizing and reportingthreats of school violence and school terrorism. (5) Establishing cooperative arrangements with local lawenforcement agencies for appropriate school-community relationships. (6) Preventing and responding to acts of hate violence andbias-related incidents, including implementation of programs andinstructional curricula consistent with the goals set forth in thissection and guidelines developed pursuant to paragraph (1) ofsubdivision (b) of Section 233. (7) For any other purpose that the school or school districtdetermines that would materially contribute to meeting the goals andobjectives of current law in providing for safe schools andpreventing violence among pupils.32228.2.  (a) Funds allocated pursuant to subdivision (b) of Section32228.1 shall be allocated to school districts with jurisdictionover eligible schoolsites, based on enrollment, with a minimumallocation of five thousand dollars ($5,000) for each schoolsite, ora minimum allocation of ten thousand dollars ($10,000) for eachschool district, whichever is greater. (b) The number of schoolsites in each school district that receivefunding for purposes of this section shall be equal to the number ofcounty-district-school codes, as maintained by the Superintendent ofPublic Instruction, for that school district as of June 30 of thefiscal year immediately preceding the fiscal year for which the fundsare allocated. (c) Funds allocated pursuant to this article shall supplement, notsupplant, expenditures for school safety and violence preventionprograms.32228.3.  For purposes of this article, "school district" means aschool district or county office of education.32228.5.  (a) The Superintendent of Public Instruction shallannually report to the Legislature regarding the use of fundspursuant to this article. (b) As a condition of receipt of funds pursuant to this article,local education agencies shall provide information for the purpose ofcompiling the annual report required pursuant to subdivision (a) tothe Superintendent of Public Instruction, in a format determined bythe Superintendent of Public Instruction.
