18720. It is the purpose of this article to ensure that theemployment procedures of each state agency conform to the federal andstate laws governing employment practices, including the use ofemployment forms. The State Personnel Board and the Department ofFair Employment and Housing shall work cooperatively to developuniform employment forms where possible pursuant to the provisions ofthis article and shall coordinate their enforcement of this article.18720.1. The State Personnel Board shall be responsible for thecollection and review of all employment forms used by state agenciesfor civil service employment and for the development of standardemployment forms for general use by all state agencies. The board maydesignate an appointing power to review employment forms inaccordance with Section 18654 and board rules. Each state agencyshall use the standard forms. However, the board, or an appointingpower designated by the board, may approve the use of a nonstandardform by a state agency if the information requested on the form isjob-related and the forms and procedures to be used conform withfederal and state law governing employment practices. Copies ofnonstandard forms approved by a designated appointing power shall betransmitted to the board. Nonstandard forms proposed by a stateagency shall be accompanied by a petition submitted by the agencywhich specifies the reasons why a nonstandard form is necessary tomeet the agency's needs.18720.2. The Department of Fair Employment and Housing shallcollect and review all other forms used by state agencies foremployment, and occupational licensing and registration, to ensureconformance to law and to develop standard forms for general use byall state agencies. Each state agency shall use the standard forms.The department, however, may approve the use of a nonstandard form bya state agency based on a petition submitted by the agency whichspecifies the reasons why a nonstandard form is necessary to meet theagency's needs.18720.3. Each state agency is responsible for ensuring that theemployment application forms, and occupational licensing andregistration forms, used by the agency conform to federal and statelaws governing registration and employment practices. An agency shallnot use a form which is not approved by either the State PersonnelBoard or by the Department of Fair Employment and Housing.18720.4. State agencies shall exhaust existing supplies of formswhich conform with federal and state law before using any new formapproved by the State Personnel Board or the Department of FairEmployment and Housing pursuant to this article.18720.5. A violation of this article shall constitute an unlawfulemployment practice which is subject to the enforcement provisions ofthe California Fair Employment and Housing Act (Chapter 7(commencing with Section 12960) of Part 2.8 of Division 3 of Title2), except Sections 12975 and 12976 thereof, or to enforcementpursuant to Article 2 (commencing with Section 18670) and Article 3(commencing with Section 18700) of this chapter and Article 2(commencing with Section 19700) of Chapter 10.
