SECTION 26172-26172.16



26172.  The commission shall do all of the following:
   (a) Adopt an annual budget.
   (b) Develop, and after a public hearing, approve and amend from
time to time the master plan.
   (c) Cause a postaudit of the financial transactions and records of
the commission to be made at least annually by a certified public
account.
   (d) Comply with Sections 19468 and 19479.



26172.2.  The commission may do any or all of the following:
   (a) Contract for goods, services, and supplies. The commission may
employ consultants and attorneys as necessary or convenient to carry
out its purposes and powers.
   (b) With the concurrence of the board of supervisors, appoint an
executive director who shall act for the commission under its
direction. If an executive director is not appointed, the county's
county librarian shall act as the executive director. All other
reasonably necessary staff services shall be provided by the county,
and the commission shall reimburse the county for the full cost of
those services, including salary or wages, and employment benefits
according to an agreement entered into between the county and the
commission.
   (c) Subject to any limitations of this chapter, exercise the
powers for providing and funding library facilities and services, as
follows:
   (1) Issue bonds pursuant to Chapter 6 (commencing with Section
29900) of Division 3 of Title 3.
   (2) Levy a special tax pursuant to the Mello-Roos Community
Facilities Act of 1982, Chapter 2.5 (commencing with Section 53311)
of Part 1 of Division 2 of Title 5.
   (3) Levy a special tax pursuant to Article 3.6 (commencing with
Section 53717) of Chapter 4 of Part 1 of Division 2 of Title 5.
   (4) Levy a retail transactions and use tax in accordance with Part
1.6 (commencing with Section 7251) of Division 2 of the Revenue and
Taxation Code.
   (5) Levy service charges and fines.
   (c) Do any and all things necessary to carry out the purposes of
this chapter.


26172.3.  No tax or assessment proposed to be levied or imposed
pursuant to Section 26172.2 shall take effect unless first approved
by the percentage of the electors in the affected territory of Shasta
County required by the principal act authorizing the tax or
assessment, or if the principal act does not require an approval by
the electorate, then the approval of any tax or assessment shall be
by a majority of the electors in the affected territory of Shasta
County voting on the issue. This section shall not apply to paragraph
(5) of subdivision (c) of Section 26172.2.



26172.4.  The commission may accept any revenue, money, grants,
goods, or services from any public agency, private entity, or person
for any lawful purpose of the commission.



26172.5.  The commission shall be deemed to be a local agency for
purposes of Section 65402.



26172.6.  Notice of the time and place of the public hearing for the
adoption of the annual budget, or the approval or amendment of the
master plan, shall be published pursuant to Section 6061 at least 10
days prior to the hearing date. The proposed annual budget, and the
proposed master plan or amendments to the plan, shall be available
for public inspection at least 15 days prior to the hearing.




26172.8.  Members of the commission may be reimbursed for reasonable
and necessary travel and other expenses incurred in the performance
of their duties, as authorized by the commission.



26172.10.  (a) Except as otherwise provided in subdivision (b), the
commission shall enter into a contract with the Board of
Administration of the Public Employees' Retirement System, and the
board shall enter into such a contract, to include all of the
officers and employees of the commission in that retirement system.
   (b) Notwithstanding subdivision (a), if the commission contracts
with the county or other agencies to utilize officers or employees of
the county or other agencies in lieu of hiring its own officers or
employees, the commission need not establish any retirement benefits
program for those officers or employees.


26172.12.  The commission has perpetual succession and may adopt a
seal and alter it at its pleasure.



26172.14.  The commission may sue and be sued, except as otherwise
provided by law, in all actions and proceedings, in all courts and
tribunals of competent jurisdiction.



26172.16.  All claims for money or damages against the commission
shall be governed by Division 3.6 (commencing with Section 810) of
Title 1, except as provided therein, or by other statutes or
regulations expressly applicable thereto.
