8260. There is in the state government, the Commission on Uniform
State Laws.
8261. The commission consists of one Member of the Senate,
appointed by the Committee on Rules, one Member of the Assembly,
appointed by the Speaker, six additional members, appointed by the
Governor, the Legislative Counsel, any person, not otherwise a member
of the commission, elected as a life member of the National
Conference of Commissioners on Uniform State Laws based upon service
as a member of the commission, and any person, not otherwise a member
of the commission, who served as a member of the commission, other
than as an appointee of the Governor, for a period of at least five
years.
The Members of the Legislature appointed to the commission shall
serve at the pleasure of the appointing power and shall participate
in the activities of the commission to the extent that the
participation is not incompatible with their respective positions as
Members of the Legislature. For the purposes of this article, the
Members of the Legislature shall constitute a joint interim
investigating committee on the subject of this article and shall have
the powers and duties imposed upon those committees by the Joint
Rules of the Senate and Assembly.
8262. Each appointed commissioner shall be any of the following:
(a) A member in good standing of the bar of this state.
(b) A person admitted to practice before the highest court of any
other state of the United States.
(c) A judge of a court of record in this state.
8263. Each appointed commissioner shall hold office for a term of
four years and until the appointment and qualification of his
successor.
8264. Upon the death, resignation or refusal to serve of any
appointed commissioner, the Governor shall make an appointment to
fill the vacancy so caused. The new appointment shall be for the
unexpired term.
8265. A commissioner is eligible for reappointment.
8266. No member of the commission shall receive any compensation
for his or her services as a commissioner, but shall receive one
hundred dollars ($100) for each day while on official business of the
commission. In addition, each member shall also be entitled to
receive actual expenses incurred in the discharge of his or her
duties, including actual and necessary travel expenses.
8267. The commission may expend in accordance with law for expenses
and actual disbursements in effectuating the objects of this
article, including travel expenses, all money made available for its
use. The commission may participate in the work of the National
Conference of Commissioners on Uniform State Laws, and may pay, from
the sums available for the support of the commission, its
proportionate share of the expenses of the National Conference of
Commissioners on Uniform State Laws. This proportionate share shall
be based upon the population of the state in comparison to that of
other states.
8268. The commission shall meet at some place in the state at least
once in every two years. It shall elect one of its members as
chairperson and another as secretary, who shall hold their respective
offices for a term of two years, and until their successors are
elected and qualified.
8269. The commissioners shall attend the meetings of the National
Conference of Commissioners on Uniform State Laws. The attendance of
a commissioner at this meeting shall be deemed an excused or
authorized absence from his or her employment.
8270. The commissioners shall do all in their power to promote
uniformity in state laws upon all subjects where uniformity is deemed
desirable and practicable.
8271. The commission shall bring about, as far as practicable, the
passage of the various uniform acts recommended by the national
conference, and shall devise and recommend such additional
legislation or other or further course of action as is deemed
necessary to accomplish the purposes of this article.
8272. The commission shall report to the Legislature from time to
time as the commission deems desirable and practicable, giving an
account of its transactions and its advice and recommendations for
legislation.
8273. Upon request of the commission, the Legislative Counsel may
assist the commission in performing its duties and, for that purpose,
may authorize the expenditure of funds appropriated for the support
of the Legislative Counsel.
