110505. Definitions and standards of identity, quality, and fill ofcontainer, and any amendments to the definitions and standards,adopted pursuant to the federal act in effect on the effective dateof this part, or adopted on or after that date, are the definitionsand standards of identity, quality, and fill of container in thisstate. The department may, by regulation, establish definitions andstandards of identity, quality, and fill of container for any foodwhether or not the definitions and standards are in accordance withthe federal regulations, when in its judgment such action willpromote honesty and fair dealing in the interest of consumers. Thissection shall not apply to wine.110510. In prescribing a definition and standard of identity forany food or class of food in which optional ingredients arepermitted, the department shall designate the optional ingredientsthat shall be named on the label. This section shall not apply towine.110515. A temporary permit which is granted by the Food and DrugAdministration of the Department of Health, Education and Welfare ofthe United States for interstate shipment of experimental packs offood that vary from the requirements of federal definitions andstandards of identity is automatically effective in this state underthe provisions provided in the permit. The department shall issue apermit when no federal permit exists and when the experimental packsare to be manufactured and tested only within this state. The permitis subject to any term or condition that the department mayprescribe.110520. Definitions and standards of identity and quality fordistilled spirits and their amendments adopted by the InternalRevenue Service of the Treasury Department of the United States ineffect on the effective date of this part, or adopted on or afterthat date, are the definitions and standards of identity and qualityfor distilled spirits in this state. The department may, byregulation, establish definitions and standards of identity andquality for any distilled spirit whether or not the definitions andstandards are in accordance with regulations adopted by the InternalRevenue Service of the Treasury Department of the United States, whenin its judgment the action will promote honesty and fair dealing inthe interest of the consumers.110525. The department may, by regulation, establish definitionsand standards of identity and quality for wine. Such definitions andstandards may incorporate in whole or in part, the regulationsadopted by the Secretary of the Treasury pursuant to the FederalAlcohol Administration Act, pertaining to the standards of identityand quality for wine. Standards of identity and quality for wineadopted pursuant to this section may differ from or be inconsistentwith the standards promulgated by the Secretary of the Treasurypursuant to the Federal Alcohol Administration Act. No standard ofsize, type, or fill of container for any wine subject to theprovisions of the Alcoholic Beverage Control Act, Division 9(commencing with Section 23000) of the Business and Professions Code,shall be adopted, but containers of wine sold in this state shallconform to the then current standards for the containers, includingstandards of fill, established by the Secretary of the Treasurypursuant to the Federal Alcohol Administration Act.
