18905. Unless the context otherwise requires, the definitionscontained in this article shall govern the construction of this part.18905.5. "Adopting agency" means a state agency responsible for theadoption of building standards.18906. "Adoption" or "adopt" means, with respect to the procedurefor promulgation of a building standard, the final act of a stateagency that has the legislative authority and responsibility to takeproposed building standards to public hearing.18907. "Approval" means, with respect to the procedure forpromulgation of a building standard, the action of approval by theCalifornia Building Standards Commission. Until there is approval ofthe standard by the commission, it shall be a proposed buildingstandard or regulation.18908. (a) "Building" means any structure used for support orshelter of any use or occupancy. "Structure" means that which isbuilt or constructed, an edifice or building of any kind or any pieceof work artificially built or composed of parts joined together insome definite manner, except any mobilehome as defined in Section18008, manufactured home, as defined in Section 18007, specialpurpose commercial coach, as defined in Section 18012.5, andrecreational vehicle, as defined in Section 18010. (b) "Building" includes a structure wherein things may be grown,made, produced, kept, handled, stored, or disposed of. (c) All appendages, accessories, apparatus, appliances, andequipment installed as a part of building or structure shall bedeemed to be a part thereof. (d) "Building" does not include machinery, equipment, orappliances installed for manufacture or process purposes only, anyconstruction installations which are not a part of a building, or anytunnel, mine shaft, highway, or bridge.18909. (a) "Building standard" means any rule, regulation, order,or other requirement, including any amendment or repeal of thatrequirement, that specifically regulates, requires, or forbids themethod of use, properties, performance, or types of materials used inthe construction, alteration, improvement, repair, or rehabilitationof a building, structure, factory-built housing, or otherimprovement to real property, including fixtures therein, and asdetermined by the commission. (b) Except as provided in subdivision (d), "building standard"includes architectural and design functions of a building orstructure, including, but not limited to, number and location ofdoors, windows, and other openings, stress or loading characteristicsof materials, and methods of fabrication, clearances, and otherfunctions. (c) "Building standard" includes a regulation or rule relating tothe implementation or enforcement of a building standard nototherwise governed by statute, but does not include the adoption ofprocedural ordinances by a city or other public agency relating tocivil, administrative, or criminal procedures and remedies availablefor enforcing code violations. (d) "Building standard" does not include any safety regulationsthat any state agency is authorized to adopt relating to theoperation of machinery and equipment used in manufacturing,processing, or fabricating, including, but not limited to,warehousing and food processing operations, but not including safetyregulations relating to permanent appendages, accessories, apparatus,appliances, and equipment attached to the building as a partthereof, as determined by the commission. (e) "Building standard" does not include temporary scaffoldingsand similar temporary safety devices and procedures that are used inthe erection, demolition, moving, or alteration of buildings. (f) "Building standard" does not include any regulation relatingto the internal management of a state agency. (g) "Building standard" does not include any regulation, rule,order, or standard that pertains to mobilehomes, manufactured homes,commercial coaches, special purpose commercial coaches, orrecreational vehicles. (h) "Building standard" does not include any regulation, rule, ororder or standard that pertains to a mobilehome park, as defined bySection 18214, or special occupancy park, as defined by Section18862.43, except that "building standard" includes the constructionof permanent buildings and plumbing, electrical, and fuel gasequipment and installations within permanent buildings in amobilehome park or special occupancy park. For purposes of thissubdivision, "permanent building" means any permanent structureconstructed in the mobilehome park or special occupancy park that isa permanent facility under the control and ownership of the parkoperator. (i) "Building standard" does not include any regulation, rule,order, or standard that pertains to mausoleums regulated under Part 5(commencing with Section 9501) of Division 8. (j) "Building standard" does not include any regulation adopted bythe California Integrated Waste Management Board, the Department ofToxic Substances Control, the Occupational Safety and HealthStandards Board, or the State Water Resources Control Boardconcerning the discharge of waste to land or the treatment, transfer,storage, resource recovery, disposal, or recycling of the waste.18910. "Code" means the California Building Standards Code,including the triennial editions and supplements.18911. "Codification" or "codify" means to arrange buildingstandards in the publication format of the code as determined by thecommission.18912. "Commission" means the California Building StandardsCommission.18913. "Emergency standard" means a building standard or an orderof repeal of a building standard filed for publication in the code bythe commission pursuant to Section 11346.1 of the Government Code.18914. "Executive director" means the Executive Director of theCalifornia Building Standards Commission.18915. "Local agency" means a city, county, and city and county,whether general law or chartered, district agency, authority, board,bureau, department, commission, or other governmental entity of lessthan statewide jurisdiction. Local agency includes any entity ofregional jurisdiction. Local agency does not include an agency of thefederal government.18916. "Model code" means any building code drafted by privateorganizations or otherwise, and shall include, but not be limited to,the latest edition of the following: (a) The Uniform Building Code of the International Conference ofBuilding Officials. (b) The Uniform Plumbing Code of the International Association ofPlumbing and Mechanical Officials. (c) The Uniform Mechanical Code of the International Conference ofBuilding Officials and the International Association of Plumbing andMechanical Officials. (d) The National Electrical Code of the National Fire ProtectionAssociation. (e) The Uniform Fire Code of the International Conference ofBuilding Officials and the Western Fire Chiefs Association, Inc. (f) Appendix Chapter 1 of the Uniform Code for BuildingConservation of the International Conference of Building Officials.18917. "Occupancy" means the purpose for which a building,structure, or other improvement to property, or a part thereof, isused or intended to be used.18917.2. "Propose" refers, with respect to the procedure forpromulgation of a building standard, to the state agency that has thelegislative authority and responsibility to write proposed buildingstandards.18917.3. "Publication" or "publish" means to print and makeavailable to the public the California Building Standards Code oradministrative regulations that apply directly to the implementationor enforcement of building standards.18917.5. "Secretary" means the Secretary of the State and ConsumerServices Agency.18918. "State agency" means a state agency as defined in Section11000 of the Government Code.18919. "Regulation" means any rule, regulation, ordinance, or orderpromulgated by a state or local agency, including rules,regulations, or orders relating to occupancy or the use of land."Regulation" includes building standards.
