SECTION 40300-40304



40300.  (a) The boards of supervisors of two or more counties within
an air basin may hold a public hearing to determine whether the
counties under their jurisdiction should become part of a regional
district.
   (b) Such boards of supervisors shall hold a public hearing to
resolve such a question, if a petition is submitted to each such
board of supervisors. A petition submitted to a board of supervisors
shall be signed by not less than 10 percent of the qualified electors
of the county under its jurisdiction.



40301.  Prior to the public hearing, the board of supervisors shall
give, not less than 15 days nor more than 45 days before the hearing,
notice of the time and place of the hearing by publication pursuant
to Section 6061 of the Government Code.



40302.  Upon conclusion of the public hearing, the board of
supervisors may adopt a resolution declaring that there is need for a
regional district to function in the county, or portion thereof, if,
from the evidence received at such hearing, it finds that it is in
the best interests of the county that a regional district function
therein.



40303.  Upon adoption of a resolution pursuant to Section 40302, the
board of supervisors shall file a certified copy of the resolution
with the state board.


40304.  From and after the date of the filing of certified copies of
resolutions from two or more boards of supervisors desiring to
create a regional district, the regional district shall begin to
function and may exercise its powers.
