6630. Notwithstanding any other provisions of this part, any personowning or having any interest in any property may at any time aftercommencement of an action or proceeding for sale or foreclosurepursuant to Chapter 6 (commencing with Section 6500) or Chapter 11(commencing with Section 6610) of this part and before sale of thatproperty to enforce the lien arising thereon for failure to make anypayment of the principal or of the interest upon any bond which hasbecome delinquent apply to the treasurer for reinstatement of thebond. As used in this part "commencement of an action or proceeding,"or variants thereof, means the date of filing with the countyrecorder of a notice of pendency of a sale or foreclosure pursuant toPart 3 (commencing with Section 3120) of Division 4.5 of this codeor, if such notice of pendency is not required to be filed with thecounty recorder, (i) in the case of proceedings for a treasurer'ssale pursuant to Chapter 6 (commencing with Section 6500) of thispart, the date of receipt by the treasurer of the written demandprovided for by Section 6500, or (ii) in the case of a foreclosureaction brought in the superior court pursuant to Chapter 11(commencing with Section 6610) of this part, the date of filing thecomplaint with the clerk of court.6631. Notwithstanding the provisions of Section 6619, the treasurershall reinstate any delinquent bond upon which an action orproceeding for sale or foreclosure has been commenced, upon thepayment to him of all principal and interest coupons delinquent atthe time of such reinstatement together with: (a) All penalties imposed pursuant to Section 6442. (b) If the proceedings are pursuant to Chapter 6 (commencing withSection 6500) of this part, the expenses of publication of notice ofsale paid or incurred by the treasurer, the cost of title search ifincurred, the fees for filing with the county recorder a notice ofpendency of sale pursuant to Part 3 (commencing with Section 3120) ofDivision 4.5, and the sum of three dollars ($3) for ascertainment bythe treasurer of the name and address of the property owner. (c) If the proceedings are pursuant to Chapter 11 (commencing withSection 6610) of this part, the costs of suit, the cost of abstractor report of search of title, authorized attorneys fees, and fees forfiling with the county recorder a notice of pendency of foreclosurepursuant to Part 3 (commencing with Section 3120) of Division 4.5. (d) A reinstatement fee determined as follows: If the action or proceeding for sale or foreclosure was commencedwithin the following periods, measured from the date of the firstdelinquent principal or interest coupon: 1. Less than six months, the reinstatement fee shall be fivedollars ($5); 2. Six months but less than a year, the reinstatement fee shall beten dollars ($10); 3. One year or more, and (i) The unpaid principal is less than one hundred dollars ($100),the reinstatement fee shall be fifteen dollars ($15); (ii) The unpaid principal is one hundred dollars ($100) or more,the reinstatement fee shall be twenty dollars ($20).6632. The holder of any bond so reinstated shall be entitled to allreinstatement payments made pursuant to Section 6631, adjusted forany difference between the estimated expenses of publication of thenotice of sale and the actual expenses paid or incurred by thetreasurer for such publication, and excepting penalties, if any,required to be retained by the treasurer pursuant to Section 6442.Upon receiving the reinstatement payments the treasurer shall enteron the record of the bond the word "reinstated," giving the datethereof. Any bond so reinstated shall have the same effect and statusas the original bond, with the same rights as to lien, payments, andforeclosure.
