42725. If the vote at either of the elections prescribed in thispart is adverse to the report, the proposed project is abandoned.Thereafter the district shall continue, and the original projectshall be and remain in the same full force and effect, as though noproceedings had been taken under this chapter.42726. If the vote at either of the elections is favorable to thenew report, nothing further shall be done toward completion of theformer project so modified or eliminated. If there is any uncalledportion of principal or interest of any outstanding assessmentalready levied and in effect to carry out the former project, theboard shall, by resolution, cancel so much thereof as is not requiredfor a refund to landowners who have already paid all or a part oftheir pro rata share of the portion to be canceled. The board shallspecify in this resolution the portion of the assessment leviedagainst each tract which is to be canceled, describing each tract asdescribed in the assessment roll or by the number of the tract asused in the assessment roll. These and subsequent proceedings underthis section shall be governed by Sections 47806, 47807, 47808,47809, and 47810.42727. To the extent that the district is indebted or has anyoutstanding liabilities at the time of adoption of the report,whether contingent or otherwise, the board shall levy, by order fromtime to time, special assessments upon the land in the district, prorata according to the rate of assessment per acre established in theoriginal assessment, to raise funds to pay the debts and liabilities.The provisions of Chapters 3 and 5 of Part 9 of this division shallbe applicable to such assessments.42728. If, after all debts and liabilities have been paid, anyfunds remain on hand which have been collected under the originalassessment or any funds are subsequently collected throughredemptions from any sale for any delinquent call on the originalassessment, such funds shall, unless distributed to landownerspursuant to Section 46675, be credited pro rata to the respectivetracts of land in the district on the assessment roll for theoriginal assessment according to the rate of assessment per acreestablished in the original assessment and thereafter shall beapplied on account for the benefit of the tracts of land against anycall on any assessment levied upon the tracts through proceedingsauthorized under this article.42729. If for any reason funds are not available to the district todefray all expenses under this article, as estimated by the board tobe incurred for the general benefit of the district up to the timethat a new assessment for the new project has been levied and becomeavailable under Chapter 2 of Part 9 of this division, the board maylevy assessments from time to time pursuant to Chapter 1 of Part 9 ofthis division to raise the necessary funds to defray such expenses.
