107.740 Recall of ordinance creating privatization project. (1) Any ordinance creating a privatization project pursuant to KRS 107.720 to 107.760, which provides for the transfer of ownership of an existing publicly-owned facility <br>to a private owner or private owner/operator, shall be subject to being recalled <br>pursuant to the public question procedure set out in KRS 83A.120, except that such <br>recall procedure shall not apply to an expansion of an existing facility. Upon the <br>receipt of a petition requesting recall, the ordinance shall be suspended from going <br>into effect pending the result of the election. If a majority of the votes cast upon the <br>question is in the negative the ordinance shall not go into effect. If a majority of the <br>votes cast upon the question is in the affirmative, the ordinance shall go into effect <br>in accordance with its terms.
