217.620 Seizure of pesticide. Any lot of pesticide not in compliance with the provisions of KRS 217.542 to 217.630 <br>shall be subject to seizure on complaint of the department to a court of competent <br>jurisdiction in the county in which said pesticide is located. In the event the court finds <br>the said pesticide to be in violation of KRS 217.542 to 217.630 and orders the <br>condemnation of said pesticide it shall be disposed of in any manner consistent with the <br>quality of the pesticide and the laws of the state; provided, that in no instance shall the <br>disposition of said pesticide be ordered by the court without first giving the claimant an <br>opportunity to apply to the court for release of said pesticide for permission to reprocess <br>or relabel said product to bring it into compliance with KRS 217.542 to 217.630.
