Identification, acceptable forms. 311.328.1.A valid and unexpired operator's or chauffeur's licenseissued under the provisions of section 302.177, RSMo, or a valid andunexpired operator's or chauffeur's license issued under the laws of anystate or territory of the United States to residents of those states orterritories, or a valid and unexpired identification card as provided forunder section 302.181, RSMo, or a valid and unexpired identification cardissued by any uniformed service of the United States, or a valid andunexpired passport shall be presented by the holder thereof upon request ofany agent of the division of alcohol and tobacco control or any licensee orthe servant, agent or employee thereof for the purpose of aiding thelicensee or the servant, agent or employee to determine whether or not theperson is at least twenty-one years of age when such person desires topurchase or consume alcoholic beverages procured from a licensee.Uponsuch presentation the licensee or the servant, agent or employee thereofshall compare the photograph and physical characteristics noted on thelicense, identification card or passport with the physical characteristicsof the person presenting the license, identification card or passport. 2.Upon proof by the licensee of full compliance with the provisionsof this section, no penalty shall be imposed if the supervisor of thedivision of alcohol and tobacco control or the courts are satisfied thatthe licensee acted in good faith. 3.Any person who shall, without authorization from the department ofrevenue, reproduce, alter, modify, or misrepresent any chauffeur's license,motor vehicle operator's license or identification card shall be deemedguilty of a misdemeanor and upon conviction shall be subject to a fine ofnot more than one thousand dollars, and confinement for not more than oneyear, or by both such fine and imprisonment.(L. 1965 p. 503 §§ 1 to 5, A.L. 1971 H.B. 365, A.L. 1972 S.B. 462,A.L. 1982 H.B. 986, A.L. 1987 S.B. 230, A.L. 1992 H.B. 1316, A.L.1993 H.B. 63, A.L. 2003 S.B. 298)
