Grievance procedure.

374.055. 1. Except as otherwise provided, any interested personaggrieved by any order of the director under the laws of this staterelating to insurance in this chapter, chapter 354, RSMo, and chapters 375to 385, RSMo, or a rule adopted by the director, or by any refusal orfailure of the director to make an order pursuant to any of saidprovisions, shall be entitled to a hearing before the director inaccordance with the provisions of chapter 536, RSMo. A final order issuedby the director is subject to judicial review in accordance with theprovisions of chapter 536, RSMo. However, any findings of fact orconclusions of law in any order regarding the actual costs of theinvestigation or proceedings under section 374.046, or the classificationof any violation under section 374.049, shall be subject to de novo review.

2. A rule adopted by the director is subject to judicial review inaccordance with the provisions of chapter 536, RSMo.

3. Notwithstanding any other provision of law to the contrary, noperson or entity shall impose an accident response service fee on or froman insurance company, the driver or owner of a motor vehicle, or any otherperson. As used in this section, the term "accident response service fee"means a fee imposed for the response or investigation by a local lawenforcement agency of a motor vehicle accident.
