29-2259.01. Probation Cash Fund; created;use; investment.(1) Thereis hereby created the Probation Cash Fund. All money collectedpursuant to subdivisions (2)(m) and (2)(o) of section 29-2262 and subdivisions (4)(a) and (4)(b) of section 60-4,115 shallbe remitted to the State Treasurer for credit to the fund.(2) Expenditures from the money in the fund collected pursuant to subdivisions (2)(m)and (2)(o) of section 29-2262 shall include, but not be limitedto, supplementing any state funds necessary to support the costs of the servicesfor which the money was collected.(3)(a) The Office of Probation Administrationshall use no more than five percent of the money in the fund collected ineach fiscal year pursuant to subdivisions (4)(a) and (4)(b) of section 60-4,115for administrative costs of the office.(b) Expenditures from the money in thefund collected pursuant to subdivisions (4)(a) and (4)(b) of section 60-4,115shall also be used to provide for the cost of installing, removing, and maintainingan ignition interlock device in accordance with subsection (9) of section 60-6,211.05. The office shall not be required to pay costs authorized underthis subdivision that exceed the amount of funds available for this purpose.(4) Any money in the fundavailable for investment shall be invested by the state investment officerpursuant to the Nebraska Capital Expansion Act and the Nebraska State FundsInvestment Act.(5) The State Treasurershall transfer any money in the Ignition Interlock Device Fund on May 14,2009, to the Probation Cash Fund.
