79-1028.02. School fiscal years 2009-10 and2010-11; American Recovery and Reinvestment Act percentage; school districtallocation; computation; school district; duties.For each of school fiscal years 2009-10and 2010-11, the American Recovery and Reinvestment Act percentage shall equalthe amount of funding from the federal American Recovery and ReinvestmentAct of 2009 to be distributed through the Tax Equity and Educational OpportunitiesSupport Act for such school fiscal year divided by the total equalizationaid to be distributed pursuant to the Tax Equity and Educational OpportunitiesSupport Act for such school fiscal year. For each school district, the AmericanRecovery and Reinvestment Act allocation shall equal the equalization aidto be distributed to the school district for such school fiscal year multipliedby the American Recovery and Reinvestment Act percentage for such school fiscalyear. Such allocation shall only be distributed upon filing of an applicationsigned by the superintendent and school board president of a school districtand filed with the department by the superintendent of such school district,which application meets the requirements of the federal American Recoveryand Reinvestment Act of 2009 and is approved by the Governor or his or herdesignee. A school district shall account for, report, and spend such allocationas required by the federal American Recovery and Reinvestment Act of 2009.Such allocation shall not be considered a special grant fund and shall beconsidered state aid for all purposes except as otherwise provided in thissection and the federal American Recovery and Reinvestment Act of 2009.
