79-249. Pupils; health inspections; rules;duties of Department of Health and Human Services; compliance with MedicationAide Act; when.The Department of Health and HumanServices shall adopt and promulgate rules and regulations for conducting schoolhealth inspections, the qualifications of the person or persons authorizedto make such inspections, and the health conditions to be observed and remediedand shall furnish to school authorities therules and regulations and other useful materials for carryingout the purposes of sections 79-248 to 79-253. The department may make available to schools methods forthe gathering, analysis, and sharing of school health data that do not violateany privacy laws.On and after July 1, 1999, no staff member of any school shalladminister medication unless the school complies with the applicable requirementsof the Medication Aide Act. Notwithstanding any other provision, nothing inthe act shall be construed to require any school to employ or use a schoolnurse or medication aide in order to be in compliance with the act.
