§1‑398.  Filing time enlarged.

The time for filing thecomplaint, petition, or any pleading may be enlarged by the court for goodcause shown by affidavit, but may not be enlarged by more than 10 additionaldays, nor more than once, unless the default was occasioned by accident overwhich the party applying had no control, or by the fraud of the opposing party.(C.C.P., s. 79; Code, s. 283; Rev., s. 716; C.S., s. 757.)
