§104E‑14.  Impounding of materials.

(a)        Authorizedrepresentatives of the Department shall have the authority in the event of anemergency to impound or order the impounding of sources of radiation in thepossession of any person who is not equipped to observe or fails to observe theprovisions of this Chapter or any rules or regulations promulgated by theCommission.

(b)        The Department mayrelease such sources of radiation to the owner thereof upon terms andconditions in accordance with the provisions of this Chapter and rules andregulations adopted hereunder or may bring an action in the appropriatesuperior court for an order condemning such sources of radiation and providingfor the destruction or other disposition so as to protect the public health andsafety. (1975, c. 718, s. 1.)
