§105‑164.35.  Excessive payments; recomputing tax.

As soon as practicable after areturn is filed, the Secretary shall examine it. If it then appears that thecorrect amount of tax is greater or less than the amount shown in the return,the tax shall be recomputed.

(1)        Excessive Payments.– If the amount already paid exceeds that which should have been paid on thebasis of the tax so recomputed, the excess shall be credited or refunded to thetaxpayer in accordance with the provisions of this Article.
