§ 110‑94. Administrative Procedure Act.

The provisions of Chapter 150B of the General Statutes shall beapplicable to the Commission, to the rules the Commission adopts, and to childcare contested cases. However, a child care operator shall have 30 days to filea petition for a contested case pursuant to G.S. 150B‑23. The contestedcase hearing shall be scheduled to be held within 120 days of the date thepetition for a hearing is received, pursuant to G.S. 150B‑23(a), in anycontested case resulting from administrative action taken by the Secretary torevoke a license or Letter of Compliance or from administrative action taken ina situation in which child abuse or neglect in a child care facility has beensubstantiated. A request for continuance of a hearing shall be granted upon ashowing of good cause by either party.
