Unless a different meaning is required by the context, the followingdefinitions shall apply throughout this Article:
(1) "Department" means the Department of Environmentand Natural Resources.
(2) "Secretary" means the Secretary of Environment andNatural Resources or his designee.
(3) "Noxious aquatic weed" means any plant organism sodesignated under this Article.
(4) "Waters of the State" means any surface body oraccumulation of water, whether publicly or privately owned and whethernaturally occurring or artificially created, which is contained within, flowsthrough, or borders upon any part of this State. (1991, c. 132, s. 1; 1997‑443, s. 11A.119(a).)
