§ 114‑19.27.  Criminalhistory record checks of applicants for licensure as marriage and familytherapists and marriage and family therapy associates.

The Department of Justice mayprovide to the North Carolina Marriage and Family Therapy Licensure Board fromthe State and National Repositories of Criminal Histories the criminal historyof any applicant for licensure or reinstatement of a license or licensee underArticle 18C of Chapter 90 of the General Statutes. Along with the request, theBoard shall provide to the Department of Justice the fingerprints of theapplicant or licensee, a form signed by the applicant or licensee consenting tothe criminal history record check and use of fingerprints and other identifyinginformation required by the State and National Repositories, and any additionalinformation required by the Department of Justice. The applicant's orlicensee's fingerprints shall be forwarded to the State Bureau of Investigationfor a search of the State's criminal history record file, and the State Bureauof Investigation shall forward a set of fingerprints to the Federal Bureau ofInvestigation for a national criminal history record check. The Board shallkeep all information obtained pursuant to this section confidential. TheDepartment of Justice may charge a fee to offset the cost incurred by theDepartment to conduct a criminal history record check under this section. Thefee shall not exceed the actual cost of locating, editing, researching, andretrieving the information.  (2009‑393, s. 18.)
