§122C‑233.  Discharges.

(a)        Except as providedin subsection (b) of this section, an incompetent adult shall be dischargedupon the request of the legally responsible person as provided in G.S. 122C‑212.

(b)        After the court hasconcurred in the admission of an incompetent adult to a 24‑hour facilityas provided in G.S. 122C‑232, only the facility or the court may releasethe incompetent adult at any time when either determines that the incompetentadult does not need further treatment at the facility. If the legallyresponsible person believes that release is in the best interest of theincompetent adult, and the facility refuses release, the legally responsibleperson may apply to the court for a hearing for discharge.
