§130A‑253.  Permit required; information report; revocation of permit.

(a)        No person shallorganize, sponsor or hold any mass gathering unless a permit has been issued tothe person by the Secretary under the provisions of this Part. A permit shallbe required for each mass gathering and is not transferable.

(b)        A permit may berevoked by the Secretary at any time if the Secretary finds that the massgathering is being or has been maintained or operated in violation of thisPart. A permit may be revoked upon the request of the permittee or uponabandonment of the operation. A permit will otherwise expire upon satisfactorycompletion of the post‑gathering cleanup following the close of the massgathering.

(c)        The Secretary, uponinformation that a congregation or assembly of people which may constitute amass gathering is being organized or promoted, may direct the organizer orpromoter to submit within five calendar days an information report to theDepartment. The report shall contain the information required for anapplication for permit under G.S. 130A‑254(b) and other informationconcerning the promotion, advertisement and preparation for the congregation orassembly and prior congregations or assemblies, as the Secretary deemsnecessary. The Secretary shall consider all available information including anyreport received and shall determine if the proposed congregation or assembly isa mass gathering. If the Secretary determines that a proposed congregation orassembly is a mass gathering, the Secretary shall notify the organizer orpromoter to submit an application for permit at least 30 days prior to thecommencement of the mass gathering.
