§130A‑309.08.  Determination of cost for solid waste management; localsolid waste management fees.

(a)        Each county andeach municipality shall annually determine the full cost for solid wastemanagement within the service area of the county or municipality for thepreceding year.  The Commission shall establish by rule the method for units oflocal government to use in calculating full cost.

(b)        Each municipalityshall establish a system to inform, no less than once a year, residential andnonresidential users of solid waste management services within themunicipality's service area of the user's share, on an average or individualbasis, of the full cost for solid waste management as determined pursuant tosubsection (a) of this section.  Counties shall provide the informationrequired of municipalities only to residential and nonresidential users ofsolid waste management services within the county's service area that are notserved by a municipality.  Municipalities shall include costs charged to them orto persons contracting with them for disposal of solid waste in the full costinformation provided to residential and nonresidential users of solid wastemanagement services.  Counties and municipalities are encouraged to operatetheir solid waste management systems through use of an enterprise fund.

(c)        For purposes ofthis section, "service area" means the area in which the county ormunicipality provides, directly or by contract, solid waste managementservices.  The provisions of this section shall not be construed to require aperson operating under a franchise contract or other agreement to collect ordispose of solid waste within the service area of a county or municipality tomake the calculations or to establish a system to provide the information requiredunder this section, unless such person agrees to do so as part of suchfranchise contract or other agreement.

(d)        A county may chargefees for the collection, processing, or disposal of solid waste as provided inArticle 15 of Chapter 153A of the General Statutes.  A city may charge fees forthe collection, processing, or disposal of solid waste as provided in Article16 of Chapter 160A of the General Statutes.
