§130A‑314.  Scope of the Article.

(a)        The provisions ofthis Article shall apply to each public water system in the State unless thepublic water system meets all of the following conditions:

(1)        Consists only ofdistribution and storage facilities and does not have any collection andtreatment facilities;

(2)        Obtains all of itswater from, but is not owned or operated by, a public water system to which thedrinking water rules apply;

(3)        Does not sell waterto any person; and

(4)        Is not a carrierwhich conveys passengers in interstate commerce.

(b)        A provision of anycharter granted to a public water system in conflict with the provisions ofthis Article is repealed. (1979, c. 788, s. 1; 1983, c. 891, s. 2.)
