§130A‑322.  Imminent hazard; power of the Secretary.

(a)        The Secretary shalljudge whether an imminent hazard exists concerning a present or potentialcondition in a public water system.

(b)        In order toeliminate an imminent hazard, the Secretary may, without notice or hearing,issue an order requiring the person or persons involved to immediately takeaction necessary to protect the public health. A copy of the order shall bedelivered by certified mail or personal service. The order shall become effectiveimmediately and shall remain in effect until modified or rescinded by theSecretary or by a court of competent jurisdiction. (1979, c. 788, s. 1; 1983, c.891, s. 2.)
