§130A‑324.  Notice of noncompliance; failure to perform monitoring;variances and exemptions.

Whenever a public watersystem:

(1)        Is not in compliancewith the drinking water rules;

(2)        Fails to perform anapplicable testing procedure or monitoring required by the drinking waterrules;

(3)        Is subject to avariance granted for inability to meet a maximum contaminant level requirement;

(4)        Is subject to anexemption; or

(5)        Fails to comply withthe requirements prescribed by a variance or exemption,

the supplier shall as soon aspossible, but not later than 48 hours after discovery, notify the Departmentand give public notification as prescribed by the drinking water rules. (1979,c. 788, s. 1; 1983, c. 891, s. 2.)
