§ 135‑43.1.  Committeeon Employee Hospital and Medical Benefits.

(a)        The Committee onEmployee Hospital and Medical Benefits shall consist of 12 members as follows:

(1)        The President ProTempore of the Senate or a designee thereof;

(2)        The Speaker of the Houseof Representatives or a designee thereof;

(3)        Five members of theSenate appointed by the President Pro Tempore of the Senate; and

(4)        Five members of theHouse of Representatives appointed by the Speaker.

(b)        The President ProTempore of the Senate and the Speaker of the House of Representatives, or theirdesignees, shall remain on the Committee for the duration of their terms inthose offices. Terms of the other Committee members are for two years. Membersmay complete a term of service on the Committee even if they do not seekreelection or are not reelected to the General Assembly, but resignation orremoval from service in the General Assembly constitutes resignation or removalfrom service on the Committee. Members shall serve until their successors areappointed.

(c)        The Committee shallreview programs of hospital, medical and related care provided by Part 3 andPart 5 of this Article and programs of long‑term care benefits providedby Part 4 of this Article as recommended by the Executive Administrator andBoard of Trustees of the Plan. The Executive Administrator and the Board ofTrustees shall provide the Committee with any information or assistancerequested by the Committee in performing its duties under this Article. TheCommittee shall meet not less than once each quarter to review the actions ofthe Executive Administrator and Board of Trustees. At each meeting, theExecutive Administrator shall report to the Committee on any administrative andmedical policies which have been issued as rules in accordance with G.S. 135‑44.8and on any benefit denials, resulting from the policies, which have beenappealed to the Board of Trustees.

(d)        The time membersspend on Committee business shall be considered official legislative businessfor purposes of G.S. 120‑3.  (1981, c. 859, s. 13.18; 1981 (Reg.
