§ 135‑43.2.  StateHealth Plan Administrative Commission.

(a)        The State HealthPlan Administrative Commission (hereinafter "Commission") is created.It is composed of three members appointed by the General Assembly as follows:

(1)        In 2008 andquadrennially thereafter, two members appointed for two‑year terms by theGeneral Assembly upon the recommendation of the Speaker of the House ofRepresentatives in accordance with G.S. 120‑121, and in 2010 andquadrennially thereafter, one member appointed for a two‑year term by theGeneral Assembly upon the recommendation of the Speaker of the House ofRepresentatives in accordance with G.S. 120‑121.

(2)        In 2008 andquadrennially thereafter, one member appointed for a two‑year term by theGeneral Assembly upon the recommendation of the President Pro Tempore of theSenate in accordance with G.S. 120‑121, and in 2010 and quadrenniallythereafter, two members appointed for two‑year terms by the GeneralAssembly upon the recommendation of the President Pro Tempore of the Senate inaccordance with G.S. 120‑121.

(b)        Terms of officeshall commence July 1 and end June 30, except that the terms of the initialmembers shall commence upon appointment and expire June 30, 2010.

(c)        The Commissioner ofInsurance or his designee serves as secretary of the Commission.

(d)        Vacancies inappointments made by the General Assembly shall be filled in accordance withG.S. 120‑122.

(e)        The Governor mayremove any member of the Commission from office after a hearing fornonfeasance, misfeasance, or malfeasance. The General Assembly may remove anymember of the Commission.

(f)         The Commissionshall elect from its membership a chair and a vice‑chair to serve termscoterminous with the terms of the members.

(g)        The Commissionmeets at the call of the chair or upon written request of at least two members.

(h)        The Commissionshall be located administratively within the Department of Insurance but shallexercise all of its prescribed statutory powers independently of theCommissioner of Insurance.

(i)         A majority of theCommission shall constitute a quorum for the transaction of business.

(j)         Members of theCommission shall receive travel allowances under G.S. 138‑6 whentraveling to and from meetings of the Commission, but shall not receive anysubsistence allowance or per diem under G.S. 138‑5.  (2008‑168, s. 2.1;2008‑187, s. 49.)
