§136‑71.13. North Carolina Bicycle Committee; composition, meetings, andduties.
(a) There is herebycreated a North Carolina Bicycle Committee within the Department ofTransportation. The Bicycle Committee shall consist of seven members appointedby the Secretary. Members of the Committee shall receive per diem andnecessary travel and subsistence expense in accordance with the provisions ofG.S. 138‑5. Initially, three members shall be appointed for two years,and four members for four years; thereafter each appointment shall be for fouryears. Upon the resignation of a member in midterm, the replacement shall beappointed for the remainder of the unexpired term. The Secretary shall makeappointments to the Committee with a view to providing representation to eachof the State's geographical regions and to the various types of bicycle usersand interests.
(b) The BicycleCommittee shall meet in various sections of the State, not less than once inany three months, and at such other times as may be necessary to fulfill itsduties. A majority of the members of the Committee shall constitute a quorumfor the transaction of business. The staff of the bicycle and bikeway programshall serve the Committee, maintain the minutes of the meetings, research questionsof bicycle transportation importance, and undertake such other activities forthe Committee as may be consistent with the program's role within theDepartment.
(c) The BicycleCommittee shall have the following duties:
(1) To represent theinterests of bicyclists in advising the Secretary on all matters directly orindirectly pertaining to bicycles and bikeways, their use, extent, location,and the other objectives and purposes of this Article;
(2) To adopt bylaws forguiding its operation, as well as an outline for pursuing a safer environmentfor bicycling in North Carolina;
(3) To assist thebicycle and bikeway program in the exercise of its duties within theDepartment; and
(4) To promote the bestinterests of the bicycling public, within the context of the totaltransportation system, to governing officials and the citizenry at large.
(d) The Secretary, withthe advice of the Bicycle Committee, shall coordinate bicycle activities amongthe divisions of the Department, as well as between the Department ofTransportation and the other departments. Further, he shall study bicycle andbikeway needs and potentials and report the findings of said studies, with theCommittee's recommendations, to the appropriate policy or legislative bodies. The Secretary shall transmit an annual report to the Governor and GeneralAssembly on bicycle and bikeway activities within the Department, including aprogress report on the implementation of this Article.
