§ 143‑151.56. Suspension, revocation, and refusal to renew license.
(a) The Board may denyor refuse to issue or renew a license, may suspend or revoke a license, or mayimpose probationary conditions on a license if the license holder or applicantfor licensure has engaged in any of the following conduct:
(1) Employed fraud,deceit, or misrepresentation in obtaining or attempting to obtain or renew alicense.
(2) Committed an act ofmalpractice, gross negligence, or incompetence in the practice of home inspections.
(3) Without having acurrent license, either performed home inspections for compensation or claimedto be licensed.
(4) Engaged in conductthat could result in harm or injury to the public.
(5) Been convicted of orpled guilty or nolo contendere to any misdemeanor involving moral turpitude orto any felony.
(6) Been adjudicatedincompetent.
(7) Engaged in any actor practice that violates any of the provisions of this Article or any ruleissued by the Board, or aided, abetted, or assisted any person in a violationof any of the provisions of this Article.
(8) (EffectiveOctober 1, 2011) Failed to maintain the requirements provided in G.S. 143‑151.58(b).
(b) A denial oflicensure, refusal to renew, suspension, revocation, or imposition of probationaryconditions upon a license holder may be ordered by the Board after a hearingheld in accordance with Article 3A of Chapter 150B of the General Statutes andrules adopted by the Board. An application may be made to the Board forreinstatement of a revoked license if the revocation has been in effect for atleast one year. (1993(Reg.
