§ 143B‑313.2.  NorthCarolina Parks and Recreation Authority; members; selection; compensation;meetings.

(a)        Membership. – TheNorth Carolina Parks and Recreation Authority shall consist of 15 members. Themembers shall include persons who are knowledgeable about park and recreationissues in North Carolina or with expertise in finance. In making appointments,each appointing authority shall specify under which subdivision of thissubsection the person is appointed. Members shall be appointed as follows:

(1)        One member appointedby the Governor.

(2)        One member appointedby the Governor.

(3)        One member appointedby the Governor.

(3a)      One member appointedby the Governor.

(3b)      One member appointedby the Governor.

(4)        One member appointedby the General Assembly upon the recommendation of the Speaker of the House ofRepresentatives, as provided in G.S. 120‑121.

(5)        One member appointedby the General Assembly upon the recommendation of the Speaker of the House ofRepresentatives, as provided in G.S. 120‑121.

(6)        One member appointedby the General Assembly upon the recommendation of the Speaker of the House ofRepresentatives, as provided in G.S. 120‑121.

(7)        One member appointedby the General Assembly upon the recommendation of the Speaker of the House ofRepresentatives, as provided in G.S. 120‑121.

(7a)      One member appointedby the General Assembly upon the recommendation of the Speaker of the House ofRepresentatives, as provided in G.S. 120‑121.

(8)        One member appointedby the General Assembly upon the recommendation of the President Pro Tempore ofthe Senate, as provided in G.S. 120‑121.

(9)        One member appointedby the General Assembly upon the recommendation of the President Pro Tempore ofthe Senate, as provided in G.S. 120‑121.

(10)      One member appointed bythe General Assembly upon the recommendation of the President Pro Tempore ofthe Senate, as provided in G.S. 120‑121.

(11)      One member appointedby the General Assembly upon the recommendation of the President Pro Tempore ofthe Senate, as provided in G.S. 120‑121.

(12)      One member appointedby the General Assembly upon the recommendation of the President Pro Tempore ofthe Senate, as provided in G.S. 120‑121.

(b)        Terms. – Membersshall serve staggered terms of office of three years. Members shall serve nomore than two consecutive three‑year terms. After serving two consecutivethree‑year terms, a member is not eligible for appointment to theAuthority for at least one year after the expiration date of that member's mostrecent term. Upon the expiration of a three‑year term, a member maycontinue to serve until a successor is appointed and duly qualified as providedby G.S. 128‑7. The terms of members appointed under subdivision (1),(3a), (5), (7), or (9) of subsection (a) of this section shall expire on July 1of years that are evenly divisible by three. The terms of members appointedunder subdivision (2), (3b), (4), (8), or (11) of subsection (a) of thissection shall expire on July 1 of years that follow by one year those yearsthat are evenly divisible by three. The terms of members appointed undersubdivision (3), (6), (7a), (10), or (12) of subsection (a) of this sectionshall expire on July 1 of years that precede by one year those years that areevenly divisible by three.

(c)        Chair. – TheGovernor shall appoint one member of the North Carolina Parks and RecreationAuthority to serve as Chair.

(d)        Vacancies. – Avacancy on the North Carolina Parks and Recreation Authority shall be filled bythe appointing authority responsible for making the appointment to thatposition as provided in subsection (a) of this section. An appointment to filla vacancy shall be for the unexpired balance of the term.

(e)        Removal. – TheGovernor may remove, as provided in Article 10 of Chapter 143C of the GeneralStatutes any member of the North Carolina Parks and Recreation Authorityappointed by the Governor for misfeasance, malfeasance, or nonfeasance. TheGeneral Assembly may remove any member of the North Carolina Parks andRecreation Authority appointed by the General Assembly for misfeasance,malfeasance, or nonfeasance.

(f)         Compensation. – Themembers of the North Carolina Parks and Recreation Authority shall receive perdiem and necessary travel and subsistence expenses according to the provisionsof G.S. 138‑5.

(g)        Meetings. – TheNorth Carolina Parks and Recreation Authority shall meet at least quarterly ata time and place designated by the Chair.

(h)        Quorum. – Amajority of the North Carolina Parks and Recreation Authority shall constitutea quorum for the transaction of business.

(i)         Staff. – Allclerical and other services required by the North Carolina Parks and RecreationAuthority shall be provided by the Secretary of Environment and NaturalResources.
