§ 20‑110.  Whenregistration shall be rescinded.

(a)        The Division shallrescind and cancel the registration of any vehicle which the Division shalldetermine is unsafe or unfit to be operated or is not equipped as required bylaw.

(b)        The Division shallrescind and cancel the registration of any vehicle whenever the person to whomthe registration card or registration number plates therefor have been issuedshall make or permit to be made any unlawful use of the said card or plates orpermit the use thereof by a person not entitled thereto.

(c)        Repealed by SessionLaws 1993, c. 440, s. 8.

(d)        The Division shallrescind and cancel the certificate of title to any vehicle which has beenerroneously issued or fraudulently obtained or is unlawfully detained by anyonenot entitled to possession.

(e)        and (f) Repealed bySession Laws 1993, c. 440, s. 8.

(g)        The Division shallrescind and cancel the registration plates issued to a carrier of passengers orproperty which has been secured by such carrier as provided under G.S. 20‑50when the license is being used on a vehicle other than the one for which it wasissued or which is being used by the lessor‑owner after the lease withsuch lessee has been terminated.

(h)        The Division mayrescind and cancel the registration or certificate of title on any vehicle onthe grounds that the application therefor contains any false or fraudulentstatement or that the holder of the certificate was not entitled to theissuance of a certificate of title or registration.

(i)         The Division mayrescind and cancel the registration or certificate of title of any vehicle whenthe Division has reasonable grounds to believe that the vehicle is a stolen orembezzled vehicle, or that the granting of registration or the issuance ofcertificate of title constituted a fraud against the rightful owner or personhaving a valid lien upon such vehicle.

(j)         The Division mayrescind and cancel the registration or certificate of title of any vehicle onthe grounds that the registration of the vehicle stands suspended or revokedunder the motor vehicle laws of this State.

(k)        The Division shallrescind and cancel a certificate of title when the Division finds that suchcertificate has been used in connection with the registration or sale of avehicle other than the vehicle for which the certificate was issued.

(l)         The Division mayrescind and cancel the registration and certificate of title of a vehicle whenpresented with evidence, such as a sworn statement, that the vehicle has beentransferred to a person who has failed to get a new certificate of title forthe vehicle as required by G.S. 20‑73. A person may submit evidence tothe Division by mail.

(m)       The Division shallrescind and cancel the registration of vehicles of a motor carrier that issubject to an order issued by the Federal Motor Carrier Safety Administrationor the Division to cease all operations based on a finding that the continuedoperations of the motor carrier pose an "imminent hazard" as definedin 49 C.F.R. § 386.72(b)(1).
