§ 20‑4.19.  Issuance ofcitation to nonresident; officer to report noncompliance.

(a)        Notwithstandingother provisions of this Chapter, a law‑enforcement officer observing aviolation of this Chapter or other traffic regulation by a nonresident shallissue a citation as appropriate and shall not, subject to the provisions ofsubsection (b) of this section, require such nonresident to post collateral orbond to secure appearance for trial, but shall accept such nonresident'spersonal recognizance; provided, however, that the nonresident shall have theright upon request to post collateral or bond in a manner provided by law andin such case the provisions of this Article shall not apply.

(b)        A nonresident maybe required to post collateral or bond to secure appearance for trial if theoffense is one which would result in the suspension or revocation of a person'slicense under the laws of this State.

(c)        Upon the failure ofthe nonresident to comply with the citation, the clerk of court shall reportthe noncompliance to the Division. The report of noncompliance shall clearlyidentify the nonresident; describe the violation, specifying the section of thestatute, code, or ordinance violated; indicate the location and date ofoffense; and identify the vehicle involved.
