§58‑47‑130.  Disclosure.

Every group through its board,TPA, service company, agents, or other representatives shall require, beforeaccepting an application, each applicant for membership to acknowledge inwriting that the applicant has received the following:

(1)        A documentdisclosing that the members are jointly and severally liable for theobligations of the group.

(2)        A copy of thegroup's plan of assessment.

(3)        The amount ofspecific and aggregate stop loss or excess insurance or reinsurance carried bythe group, the amount and kind of risk retained by the group, and the name andrating of the insurer providing stop loss, excess insurance, or reinsurance. (1997‑362,s. 3.)
