§ 58‑50‑285. Policies and procedures.

(a)        A health benefitplan or insurer shall provide a copy of its policies and procedures to a healthcare provider prior to execution of a new or amended contract and annually toall contracted health care providers. Such policies and procedures may beprovided to the health care provider in hard copy, CD, or other electronicformat, and may also be provided by posting the policies and procedures on theWeb site of the health plan or insurer.

(b)        The policies andprocedures of a health benefit plan or insurer shall not conflict with oroverride any term of a contract, including contract fee schedules. In the eventof a conflict between a policy or procedure and the language in a contract, thecontract language shall prevail.  (2009‑352, s. 1.)
