§ 58‑82A‑3. (Effective February 1, 2010) Display operator permit.
(a) Permit Required. Adisplay operator permit issued by the State Fire Marshal is required for anindividual to obtain the necessary authorization under Article 54 of Chapter 14of the General Statutes to exhibit, use, handle, manufacture, or dischargepyrotechnics at a concert or public exhibition in this State. A permit issuedunder this section is valid for three years unless it is revoked by the StateFire Marshal.
(b) Requirements. TheState Fire Marshal may issue a display operator permit to an individual if allof the following conditions are met:
(1) The individual is atleast 21 years of age.
(2) The individual hasassisted with the exhibition, use, or display of pyrotechnics at a concert orpublic exhibition, as allowed under Article 54 of Chapter 14 of the GeneralStatutes, on at least three occasions.
(3) The individualsuccessfully completes the minimum training requirements established by theState Fire Marshal.
(4) The individualsuccessfully passes an examination approved by the State Fire Marshal thatdemonstrates the individual has the knowledge to safely handle, store, andexhibit Class 1.3g and 1.4g pyrotechnics or provides satisfactory evidence ofcurrent certification by a third party acceptable to the State Fire Marshal.
(5) The individual paysan application fee not to exceed one hundred dollars ($100.00) and the cost ofthe examination.
(c) Reciprocity. TheState Fire Marshal may issue a display operator permit to an individual whoholds a permit or certification issued by another state, provided the minimumrequirements of that state are at least equal to the minimum requirements underthis section and the person pays the application fee required under subsection (b)of this section.
(d) Refusal andRevocation. The State Fire Marshal may refuse to issue a permit or may revokea permit issued under this section if any of the following apply:
(1) The display operatorviolates any provision of this Article.
(2) The display operatorviolates any requirement of a permit issued under G.S. 14‑413.
(3) The display operatorfails to provide direct supervision and control over individuals who assist thepermit operator in handling, using, exhibiting, or displaying pyrotechnics.
(4) The display operatoris convicted of a crime under Article 54 of Chapter 14 of the General Statutes.
(5) Another staterevokes the permit or certification issued to that display operator by thatstate. (2009‑507,s. 3.)
