§89E‑5.  Functions and duties of the Licensing Board.

(a)        The Board shalladminister and enforce the provisions of this Chapter.

(b)        The Board shallelect from its membership a chairman, a vice‑chairman and a secretary‑treasurer,and adopt rules, consistent with the Administrative Procedures Act, to governits proceedings.  A majority of the membership of the Board shall constitute aquorum for all Board meetings.

(c)        The Board shallexamine and pass on the qualifications of all applicants for licensing underthis Chapter, and shall issue a license to each successful applicant therefor.

(d)        The Board may adopta seal which may be affixed to all licenses issued by the Board.

(e)        The Board mayauthorize expenditures deemed necessary to carry out the provisions of thisChapter and all expenses shall be paid upon the warrant of the Boardtreasurer.  The Board treasurer shall deposit funds received by the Board inone or more funds in banks or other financial institutions carrying depositinsurance and authorized to do business in North Carolina.  Interest earned onsuch funds may remain in the funds account and may be expended as authorized bythe Board to carry out the provisions of this Chapter.  In no event mayexpenditures exceed the revenues of the Board during any fiscal year.  TheBoard is authorized and empowered to utilize the services of the Purchase andContract Division of the Department of Administration for the procurement ofpersonal property, in accordance with Article 3 of Chapter 143 of the GeneralStatutes.

(f)         The Board shallhold a meeting within 30 days after a quorum of its members is first appointedand thereafter shall hold at least two regular meetings each year.

(g)        The Board shallestablish and receive fees as required by this Chapter.  In establishing fees,the Board shall consider exemptions from fees or a reduction in licensing feesfor those persons otherwise qualified for licensing under this Chapter but whoperform geologic work or services less than 15 days per year.

(h)        The Board shallhave such other powers and duties as are necessary to carry out the provisionsof this Chapter.

(i)         The Board shallhave the power to establish or approve reasonable standards for licensing andrenewal of licenses of geologists, including, but not limited to the power toadopt or use examination materials and accreditation standards of any dulyprofessionally recognized accrediting agency.  The Board shall have the powerto establish reasonable standards for continuing professional education for geologists,provided that for renewal of license no examination shall be required.
