§90A‑37.  Classification of water pollution control systems.

The Commission, with theadvice and assistance of the Secretary of Environment and Natural Resources,shall classify all water pollution control systems. In making theclassification, the Commission shall give due regard, among other factors, tothe size of the system, the nature of the wastes to be treated or removed fromthe wastewater, the treatment process to be employed, and the degrees of skill,knowledge and experience that the operator of the water pollution controlsystem must have to supervise the operation of the system so as to adequatelyprotect the public health and maintain the water quality standards of thereceiving waters as assigned by the North Carolina Environmental ManagementCommission.
