CHAPTER 11 - Common Carriers by Air

 

37-11-101. Definitions.

 

(a) As used in W.S. 37-11-101 through 37-11-103, unless thecontext otherwise requires, the term "person" means any individual,firm, co-partnership, corporation, company, association, joint-stockassociation or body politic, and includes any trustee, receiver, assignee orother similar representative thereof.

 

(b) "Common carriers by air" as used in this actmeans any person or persons engaged in regularly scheduled air transportationof persons or property for compensation or hire within the state of Wyomingconcerning those activities where the United States has not excluded the statesfrom regulating.

 

37-11-102. Conditions precedent to issuance of certificate.

 

Nocertificate of public convenience and necessity shall be issued by thedepartment of transportation to any person authorizing operation, as a common carrierby aircraft in Wyoming intrastate commerce, unless and until the applicantshall have submitted to the department a certificate, signed by the director ofthe Wyoming aeronautics commission, to the effect that the applicant hascomplied with the laws of the United States, the laws of the state of Wyoming,and the lawful rules, regulations and orders, respecting safety of operations;and the provisions of the "Uniform State Law for Aeronautics", withrespect to the right to use airports, airlanes and aircraft as necessary inorder to properly conduct the proposed operations and observe proper standardsof safety in the operation or navigation of aircraft. The Wyoming aeronauticscommission shall require all applicants for a certificate of public convenienceand necessity to furnish to it such evidence as it may require showing thatthey have complied in all respects with the laws, rules, regulations andorders.

 

37-11-103. Hearings; right of aeronautics commission or director tointervene.

 

Whenevera hearing is scheduled before the department of transportation in anyproceeding for authority to conduct common aircraft operations in Wyomingintrastate commerce, it shall be the duty of the director of the department tonotify the administrator of the Wyoming aeronautics commission; and the Wyomingaeronautics commission or its administrator may intervene in the proceedingsfor the purpose of setting up the interests of the Wyoming aeronauticscommission.
