28-7672. Highway expansion and extension loan program advisory committee

A. The highway expansion and extension loan program advisory committee is established consisting of the following seven members:

1. Two members of the public appointed by the speaker of the house of representatives.

2. Two members of the public appointed by the president of the senate.

3. Two members of the public who are appointed by the governor and who represent counties with a population of less than one million five hundred thousand persons according to the most recent United States decennial census.

4. The director or the director's designee who serves as chairperson of the committee.

B. Members of the committee shall represent a broad spectrum of the transportation community.

C. Appointed members of the committee serve staggered four year terms and shall not serve more than two consecutive terms.

D. The committee shall:

1. Develop a simplified application form for financial assistance pursuant to this article and guidelines for loans and financial assistance provided pursuant to this article and submit the application form and guidelines to the board.

2. Review requests for loans and financial assistance pursuant to this article.

3. Make recommendations to the board on requests for loans and financial assistance pursuant to this article.

4. Submit a report to the governor, the speaker of the house of representatives and the president of the senate on the highway expansion and extension loan program on or before December 1 of each year. The report shall include the following:

(a) The financial and operational status of the projects assisted by the fund.

(b) The financial condition of the fund, including fund balances.

(c) The extent to which projects assisted by the fund have aided this state in meeting this state's transportation needs and have generated economic benefits.

E. The department shall provide staff for the committee.

F. The committee may take any of the actions prescribed in this section by a resolution.

G. The committee is exempt from the requirements of title 41, chapter 6.

H. Members of the committee are not eligible to receive compensation but are eligible for reimbursement of expenses pursuant to title 38, chapter 4, article 2.
