42-5105. Administrative rulings

The department may issue an administrative ruling in response to a written inquiry from any retailer of food regarding the application of this article. The inquiry shall state with specificity the facts involved in the question. The ruling shall be determinative of subsequent treatment of the matter and may be relied upon by the retailer until a regulation related to the subject of the inquiry is adopted. The ruling and the date of its issuance shall be published with the rules and regulations of the department. Any ruling remains in effect until a regulation related to the subject of the inquiry is adopted.
