    Sec. 1. This Act may be cited as the Illinois Street Trades Law.

    Sec. 3. No employer shall employ any minor, nor shall an employer allow or permit any minor to work, in any street trade unless, within 90 days of the effective date of this Act, he or she has obtained a certificate from the Department evidencing his or her registration with the Department.

    Sec. 4. No minor shall engage in any street trade unless he or she has been issued a permit by his employer to do so.

    Sec. 5. Upon the receipt of an application, the forms for which have been obtained from the Department, accompanied by a fee of $50, the Department shall issue a non‑transferable certificate of registration to the applicant employer. Applications shall include the following information:
    (a) the name and address of the applicant employer;
    (b) the names and addresses of all owners, partners, directors, officers, and others owning more than 10% interest in the entity named as employer;
    (c) the nature of the street trade in which minors will be employed;
    (d) an oath or affirmation that all information contained in the application is true and complete;
    (e) such information as the Department shall require.

    Sec. 5.1. Certificates shall be issued without expiration date, and shall remain in effect until surrendered by the employer. Certificates shall be kept at the place of business of the employer, and shall be displayed in a prominent place therein.

    Sec. 5.2. Each certificate issued shall be accompanied by 10 permit forms without additional charge. Each employer may, from time to time at or after the time of application, obtain additional permit forms from the Department by paying a fee of $5 for each 10 permits.

    Sec. 5.3. The employer shall issue to each minor engaged in a street trade a permit on a form issued by the Department, which permit shall not be transferable from one employee to another. The permit shall be carried at all times by the minor while he or she is engaged in a street trade.

    Sec. 6. Each employer who issues a permit to an employee or other minor shall, within 2 business days of issuing the permit, inform the Department of the name, address, and such other information as the Department shall require, by returning the reply card provided with the permit.

    Sec. 7. The Department shall provide the following forms without charge, except for fees authorized by this Act:
    (a) Application forms for certificates of registration.

    Sec. 8. (a) The provisions of this Act shall be administered and enforced by the Department of Labor.
    (b) Each police officer and truant officer in the State of Illinois shall assist the Department in its enforcement duties by requiring a show of permit by minors observed on the streets who are engaged in street trades.

    Sec. 9. (a) Any employer other than a corporation who or which violates any of the provisions of this Act is guilty of a Class C misdemeanor.
    (b) Any corporation which violates any of the provisions of this Act is guilty of a petty offense, and shall be fined $500.
    (c) Any failure of an employer defined as such in this Act to produce for inspection a certificate of registration issued by the Department when requested to do so by a police officer, truant officer or agent of the Department of Labor, and any failure to produce a permit by a minor employee, will give rise to a presumption that the employer is unlawfully employing minors in street trades.

    Sec. 10. If any provision of this Act or the application thereof to any person or circumstance is held invalid, such invalidity does not affect other provisions or applications of this Act which can be given effect without the invalid application or provision, and to this end the provisions of this Act are declared to be severable.
