Chapter 24.--DRAINAGE AND LEVEES
Article 12.--WATERSHED DISTRICTS

      24-1203a.   Establishment of district initiated by board of countycommissioners.(a) In lieu of the proceduresprovided by K.S.A. 24-1203, 24-1204 and 24-1205, andamendments thereto, the board of county commissioners of any county may adopt aresolution proposing the establishment of one or more watershed districtswithin the county and appointing the steering committee of each proposeddistrictif:

      (1)   The lands within each proposed district comprise substantially awatershed or two or more adjoining watersheds, as determined by the chiefengineer; and

      (2)   in the preceding five-year period, the governor has issued aproclamation declaring a state of disaster emergency in the county due toflooding.

      (b)   The resolution shall contain the information required for a petitionunder K.S.A. 12-1204, and amendments thereto, and shall have appended andincorporated by reference a map showing the lands to be included in eachproposed district and the subwatersheds therein, prepared in consultation withthe chief engineer.

      Upon adoption of such resolution, the county commission shall transmit acertified copyof the resolution to thechief engineer.

      (c)   All costs of projects and works of a watershed district establishedunder this section shall be paid by a general levy against all taxable tangibleproperty located within the district.

      (d)   This section shall be part of and supplemental to the watershed districtact.
