Chapter 24.--DRAINAGE AND LEVEES
Article 12.--WATERSHED DISTRICTS

      24-1228.   Dissolution of district, when; resolution;petition;election; certificate of dissolution.Whenever a watershed district has been organized and incorporated undertheprovisions of article 12 of chapter 24 of the Kansas StatutesAnnotated, and amendments thereto, for more than eight years andhas not adopted a generalplan of work andprojects to be undertaken by the district, constructed or contractedto construct any works of improvement or incurred anycontinuingobligations for maintenance of any works of improvement, or when such adistrict has been organized and incorporated under such provisions for morethan four years and has not made substantial progress toward a general plan ofwork and projects to be undertaken by the district, the board of suchdistrict may, by resolution adopted by a2/3 vote of allmembers of such board present and voting, but in no event less than amajority of all members of such board at a special meeting of such boardcalled for that purpose, and notice of which special meeting shallspecify the purpose for which the meeting is to be called, provide forthe calling of an election of the qualified voters of such district forthe purpose of determining whether such district shall be dissolved; andthe board shall provide for the calling of such an election ifwritten petitions therefor signed by 20% of thelandowners of such district, as shown by a verified enumerationof suchlandowners by a landowner of such district, are filed with the secretaryof such board. Notwithstanding any provision of this section, the MiddleCreek joint watershed district No. 50 may be dissolved in thesame manner and procedure as provided herein.

      The election to determine whether the district shall be dissolvedshall be held and conducted in the same manner as provided by K.S.A.24-1207, and amendments thereto, insofar as such provisions can be madeapplicable. If a majority of thosevoting on the proposition voted in favor of dissolution of the district,the board shall immediately certify the results of such election to thesecretary of state, and the secretary of state shall thereupon issue anddeliver to the secretary of such board a certificate of dissolution.
